Carefully Review of Terms of Use Before Accessing Our Website

The User is encouraged to regularly review the Terms to remain informed of any updates.

If you do not agree with the amended Terms, you may request termination of your access to the Platform. Continued use of the Platform after changes have been posted constitutes your acceptance of the updated Terms.

Language

All information, documentation, and communication from Whitechapel Securities shall be provided in English. Users must refer to the English version of the Platform and related materials for all disclosures relating to the Company’s services.

Security Obligations

The User agrees to safeguard all login credentials (including usernames and passwords) provided by Whitechapel Securities and to prevent unauthorised access to the Platform. The User further agrees not to engage in any activities that could compromise the security or integrity of the Platform.

The Company reserves the right to suspend or terminate Platform access at its discretion to protect its systems, interests, or those of its clients.

User Responsibilities

The User agrees to take all necessary steps to assist the Company in fulfilling its regulatory obligations, including promptly notifying Whitechapel Securities of any suspected misuse of their Platform access credentials.

Use of platform

The User is permitted to view and generate information regarding their account(s) with Whitechapel Securities, including but not limited to trade confirmations, portfolio valuations, and account activity reports.

The Platform and its contents may not be copied, reproduced, distributed, or exploited for commercial purposes without prior written consent from the Company. Unauthorised use will result in the immediate termination of any licence granted herein.

Third party access

Clients may authorise a Nominated Third Party to access their account information through the Platform, subject to completing and submitting the Company’s Third Party Access Authorisation Form.

The User agrees to indemnify and hold harmless Whitechapel Securities, its directors, employees, agents, and affiliates from any losses, claims, or damages arising from:

Disclaimer

The Platform is provided “as is” and “as available.” Whitechapel Securities makes no warranties, express or implied, regarding the reliability, accuracy, or fitness for a particular purpose of the Platform. The Company does not guarantee uninterrupted or error-free access, nor does it warrant that the Platform is free from viruses or harmful components.

The Company does not endorse or take responsibility for third-party products, services, or content that may appear on or be accessible through the Platform.

Intellectual property

All materials on the Platform, including logos, designs, text, images, and proprietary information (the “Content”), are the property of Whitechapel Securities or its licensors and are protected by copyright and other intellectual property laws. No content may be reproduced, distributed, or modified without the Company’s prior written approval.

Governing law and jurisdiction

These Terms are governed by the laws of Australia. Both the User and Whitechapel Securities irrevocably submit to the exclusive jurisdiction of the courts of Australia for the resolution of any disputes arising from these Terms.

Notices

The Company may deliver notices to the User through the Platform, via email, or to the postal address provided by the User. Users must direct formal notices or correspondence to:

Assignment

The User may not transfer or assign any rights or obligations under these Terms. Whitechapel Securities reserves the right to assign or transfer any of its rights and obligations to third parties at its sole discretion.

Entire agreement

These Terms, along with any referenced policies and documents, constitute the entire agreement between the User and Whitechapel Securities concerning access to and use of the Platform.

If any provision is deemed unlawful or unenforceable, the remaining provisions shall remain valid and enforceable.
